Before, During and After January 6, 2021
A presentation by the Committee on Special Issues of National and State Importance and Criminal Law Section of the Virginia Bar Association at the 132nd Summer Meeting
The events of Jan. 6, 2021, are seared into the collective memories of all who witnessed the images at the United States Capitol on that historic day. This presentation will explore the events that preceded the incursion, what actually happened on Jan. 6 and the consequences of this pivotal day in American history. The events leading up to passage of the Electoral Count Act of 1887, or ECA, will be discussed. Important aspects of the ECA and its application to the 2020 election will be debated, including whether the ECA is constitutional. Among other thought-provoking questions that the panel will address is whether there could be a recurrence of the problems the nation experienced in connection with the 2024 presidential election.
